Here is one of our most difficult successes ... Bradley R. Beard vs Heather Ann Maroudis in the Circuit Court for the County of Livingston Brad, a healthy, strong young man, a go-getter and a manager of a retail carpet company, was on his way home when an 18 year old girl turned in front of him and the resulting accident totaled his Buick automobile. When I met with Brad at his home, his only injury seemed to be a fractured pelvis which did not require any surgery but only that he rest and be immobile, on his back, for some 60 days. The case was interesting and difficult because after some 6 to 7 months post-accident, Brad developed radiating pain and numbness down a leg. It was learned that he had a herniated disc, the treatment for which required two surgeries, one of which was a fusion. The insurance company and their doctors were contesting responsibility for the herniated discs on the basis that the treating doctor did not note any symptoms of back pain or radiating pain over the 6 months of treatment for the injury to the pelvis. Fortunately, I had referred for a second opinion and that doctor noted presence of back pain. He later was the referring physician to the surgeon who performed the fusion surgery and provided the causal connection to establish that, indeed, the car crash more likely than not was the cause of the herniated disc. The defendant’s insurance company decided to settle the case one month before trial rather than proceed. |
